Effective Date: July 18, 2025
By accessing or using brewbot.xyz services ("Services"), including but not limited to visiting the brewbot.xyz website ("Website"), purchasing premium access, or adding the Brewbot ("Bot") to your Discord server, you ("User") hereby acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Agreement"). If you do not agree to these terms in their entirety, you are expressly prohibited from using the Services and must discontinue use immediately.
In this Agreement:
"brewbot.xyz," "Brewbot," "we," "us," and "our" refer to brewbot.xyz and its affiliates, directors, officers, employees, and agents. "Services" means all products, features, applications, websites, or other services operated by brewbot.xyz. "User," "you," and "your" refer to any individual or entity using our Services. "Premium Service" refers to the paid bot functionality available for purchase.
3.1 The User shall comply with all applicable local, state, national, and international laws and regulations in connection with the use of the Services.
3.2 User acknowledges that use of the Services is additionally subject to Discord's Terms of Service and Community Guidelines, and any violation thereof constitutes a violation of this Agreement.
3.3 User shall promptly report any violations of applicable laws, regulations, or Discord policies to brewbot.xyz via email at contact@brewbot.xyz or through our Discord support server at discord.gg/brew.
3.4 Servers found to be in violation of Discord's Terms of Service or Community Guidelines will have bot access terminated until compliance can be demonstrated.
4.1 Purchase Terms: Premium bot access is available for a one-time purchase of $24.99 USD per Discord server.
4.2 Server Transfer: After purchase, the bot may be transferred to a different server ONE (1) time only. Additional transfers are not permitted.
4.3 Payment Processing: All payments are processed through Square, our third-party payment processor. Payment disputes must be handled directly through Square.
4.4 Refunds: All refund requests must be processed through our third-party payment processor. Upon refund approval, bot access will be immediately removed from the corresponding server.
4.5 Unauthorized Chargebacks: Any unauthorized chargeback will result in immediate removal of bot access and permanent blacklisting from all brewbot.xyz services.
User is expressly prohibited from engaging in the following activities in relation to the Website:
5.1 Any attempt to exploit, hack, damage, disrupt, or gain unauthorized access to the Website or its systems;
5.2 Any use of the Website for unlawful, fraudulent, or malicious purposes;
5.3 Scraping, collecting, or harvesting any information from the Website for unauthorized purposes;
5.4 Framing or mirroring any portion of the Website without prior written authorization;
5.5 Copying, reproducing, distributing, or claiming ownership of any content, design elements, or proprietary information from the Website.
6.1 User is expressly prohibited from engaging in the following activities in relation to the Bot:
a. Violation of Discord's Terms of Service or Community Guidelines;
b. Reproducing, duplicating, copying, selling, or reselling any portion of the Bot's functionality;
c. Facilitating, enabling, or encouraging others to reproduce brewbot.xyz's services or features;
d. Exploitation of bugs, glitches, or vulnerabilities in the Bot's functionality;
e. Operation of a Discord server that has been previously terminated for policy violations;
f. Organizing, participating in, or encouraging harassment, "raids," or targeted attacks against brewbot.xyz or its staff;
g. Ban evasion through the use of alternative accounts or servers;
h. Intentionally allowing minors access to NSFW content or operating servers with improperly marked NSFW channels;
i. Operating servers that pose a liability to brewbot.xyz's reputation or violate community safety standards.
6.2 Enforcement Rights. brewbot.xyz reserves the right, at its sole and absolute discretion, to:
a. Terminate access to the Services, temporarily or permanently, with or without prior notice;
b. Remove, disable, or restrict the availability of any content;
c. Blacklist users and alternative accounts permanently from all services;
d. Take appropriate legal action against Users who violate these terms;
e. Pursue any and all remedies available at law or in equity for violations of this Agreement.
6.3 No Waiver. brewbot.xyz's failure to enforce any right or provision of this Agreement shall not be considered a waiver of such right or provision.
7.1 Server Responsibility: Server administrators and moderators are solely responsible for ensuring their Discord servers comply with all applicable terms of service and community guidelines.
7.2 Moderation Tools: brewbot.xyz provides moderation commands and AutoMod management features. Servers are expected to utilize these tools or suitable alternatives to maintain safe environments.
7.3 NSFW Content Compliance: Servers must properly mark NSFW channels according to Discord's guidelines. Intentionally allowing minors access to NSFW content is strictly prohibited and will result in immediate service termination.
7.4 Reporting System: brewbot.xyz relies on community reports to identify problematic servers. Users are encouraged to report violations through discord.gg/brew or contact@brewbot.xyz.
7.5 Liability Disclaimer: brewbot.xyz is not liable for user-generated content within Discord servers and relies on server moderation staff to ensure member safety.
8.1 External Services: Our Services integrate with Google (text and image queries), OpenWeatherMap (weather data), Last.fm (music data), Square (payment processing), and other third-party services.
8.2 Third-Party Terms: Users acknowledge that use of integrated services may be subject to additional terms and conditions imposed by those third parties.
8.3 Data Processing: User data may be processed through our PostgreSQL database system as outlined in our Privacy Policy.
9.1 Blacklist Policy: Terminated users will have their User ID and relevant data (including termination reasoning) retained for blacklist enforcement purposes.
9.2 Data Removal: User data will be retained unless specifically requested for removal in accordance with our Privacy Policy.
9.3 Ban Evasion: Any attempt to circumvent account restrictions through alternative accounts will result in immediate blacklisting of all associated accounts.
10.1 Technical Support: Support requests can be submitted through discord.gg/brew or contact@brewbot.xyz.
10.2 Documentation: Service documentation is available at docs.brewbot.xyz.
10.3 Payment Disputes: All payment-related disputes must be handled directly through Square, our payment processor.
11.1 Non-Guaranteed Availability: brewbot.xyz does not guarantee continuous, uninterrupted, or secure access to our Services.
11.2 Discretionary Service Provision: brewbot.xyz reserves the absolute right to refuse service, terminate accounts, or remove access if user conduct violates applicable law, threatens service integrity, or conflicts with our business interests.
11.3 Survival of Terms: All provisions which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
12.1 User agrees to defend, indemnify, and hold harmless brewbot.xyz, its affiliates, and service providers from any claims, liabilities, damages, or expenses arising from User's violation of this Agreement or use of the Services.
13.1 UNDER NO CIRCUMSTANCES SHALL BREWBOT.XYZ BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM USER'S ACCESS TO OR USE OF THE SERVICES.
14.1 brewbot.xyz reserves the right to modify this Agreement at any time without notice.
14.2 Continued use of the Services constitutes acceptance of any amendments.
14.3 Violation of amended terms may result in immediate termination of access to all Services.
15.1 If any provision is found unenforceable, it will be limited to the minimum extent necessary while keeping the remainder in full force.
15.2 This Agreement constitutes the entire agreement between brewbot.xyz and User regarding the Services.
